Student Internet Access Act - Summary

Provisions for Libraries:
- Must use Internet filtering software to restrict access by minors (persons under 18) to prohibited materials (see below).
- Must have an adult library employee monitor the terminals used by minors.
- Must arrange the terminals in a configuration that allows a library staff employee to view the terminals used by minors at all times.
Prohibited materials:
- Obscenity (as in Federal law)
- Gross depictions (crudely vulgar, grossly uncivil, scatological: includes maiming, bloody figures, indecent depiction of bodily functions.)
- Depictions of sexual acts (undefined)
- Depictions of full and partial nudity
- Information encouraging or advocating:

- satanic cults
- intolerance (prejudice/discrimination against race, color national origin, religion, disability or handicap, gender or sexual orientation; includes intolerant jokes and slurs)
- militant or extreme behavior (aggressive and combative or which advocates unlawful action or activity)
- violence (extreme cruelty, or physical or emotional act against person or animal to hurt or inflict pain) or profanity (obscene words or phrases)
- sale, consumption or production of illicit drugs or alcohol products
Penalties: State Treasurer empowered to withhold any form of State library aid, not to exceed 10% of the previous year allocation, from any county, municipality or area library.
Monetary provisions: The Commission of Education will establish a program to reimburse school districts or libraries for the cost of filtering software to comply. The Legislature will appropriate a sufficient sum.
